Terms and Conditions – AIX Commerce AB (toolwiser.com)

1. General

These terms and conditions apply to all purchases of car lifts, tools, and accessories made on toolwiser.com (distance contracts). By completing a purchase, you agree to these terms.

We sell to both consumers (private individuals) and businesses (traders) within the EU.

2. Price and Payment

All prices are stated in euros
excluding VAT.

For consumers (B2C): VAT is added according to the applicable tax rate in your EU country (calculated automatically at checkout based on the delivery address).

For businesses (B2B) with a valid VAT number: VAT is handled according to the reverse charge mechanism (intra-EU sale). Enter your VAT number at checkout for VAT exemption.

The total price including VAT (if applicable), shipping, and mandatory fees is clearly shown before the purchase is completed. Shipping costs are added and displayed separately. Payment is made according to the options available at checkout.

3. Delivery

Delivery within the EU. Normal delivery time: [e.g. 3–10 business days] from order processing. The risk transfers to you upon receipt of the goods (by you or your representative).

4. Right of Withdrawal

Consumers only (private individuals): According to EU law, you have a 14-day right of withdrawal from the day you (or your representative) physically receive the goods. You
must clearly notify us (by email to [rhello@toolwiser.com] or via a return form) within 14 days.

You are responsible for the return shipping costs and for the condition of the goods during the return. The goods must be returned in substantially unchanged condition and in the original packaging if possible.

We will refund the full purchase price (including any standard delivery cost to you) no later than 14 days after receiving your withdrawal notice and the returned goods or proof of return. The refund will be made using the same payment method used for the purchase.

The right of withdrawal does not apply to custom-made goods or goods with a clearly personalized character.

For businesses (B2B): No statutory right of withdrawal applies under EU law.

5. Complaints and Statutory Warranty

Consumers only (private individuals): In addition to any right of withdrawal, you have at least a 2-year legal warranty period under EU law from the date of delivery.

If a defect occurs (the product deviates from the agreement, is defective, or has lower quality than reasonably expected), you have the right to repair, replacement, price reduction, or contract termination.

We cover shipping costs for approved complaints. Complaints must be made within a reasonable time (within 2 months of discovering the defect is always considered reasonable).

In the case of repairs, we primarily replace the damaged or defective part (spare part). Technician work or labor costs (such as installation, removal, or workshop work) are not included and are your responsibility. This does not affect your other statutory rights.

For businesses (B2B): No statutory consumer warranty rights apply. Any defects are handled according to the voluntary warranty below or according to agreement.

6. Voluntary Warranty

We provide a 1-year voluntary warranty for both consumers and businesses (in addition to any statutory rights for consumers). The warranty covers material and manufacturing defects during normal use.

In the event of an approved warranty claim, we primarily replace the damaged or defective part (spare part). Technician work or labor costs are not included. You are responsible for installation, removal, or external work.

The warranty does not cover wear and tear, incorrect installation or use, accidents, or use outside the intended purpose. This voluntary warranty does not replace or limit statutory rights for consumers.

7. Order Cancellation After Shipment

If you cancel or withdraw from the purchase after the goods have left our warehouse, we will charge the actual shipping costs for both outbound and return transport. This also applies when exercising the right of withdrawal for consumers. This does not apply in cases of complaints or defective goods.

8. Liability

We are not liable for indirect damages, loss of profit, or damages resulting from incorrect use or installation.

9. Disputes and Complaints

We comply with applicable EU legislation.

For consumers: In case of disputes, we follow the relevant dispute resolution body. You may also use the EU Online Dispute Resolution platform:

For businesses: Disputes shall be settled under Swedish law in [relevant court, e.g. Stockholm District Court], unless otherwise agreed.
